Terms of Service
These Terms of Service ("Terms") govern your use of the TrendPlay Arcade mobile application and the trendplay.games website (together, "the App"). The App is published by Sai Krishna Mallam ("we", "us"). By installing or using the App you agree to these Terms. If you do not agree, please do not use the App. How we handle your data is covered separately in our Privacy Policy, which forms part of these Terms.
1. Agreement to These Terms
The App is a free, ad-supported collection of casual arcade games. These Terms are a binding agreement between you and us covering how you may use it. Some features, such as global leaderboards and cloud-synced progress, require an account and an internet connection. Most games can be played fully offline.
2. Who Can Use the App
You must be at least 13 years old, or the higher minimum age that applies where you live (for example 16 in parts of the European Economic Area), to use the App. The App is not directed to children below that age and we do not knowingly allow them to create accounts. If you believe a child has created an account, contact us at saikrishnamallam@live.com and we will remove it.
3. Your Account
You can play as a guest, or create an account with a username and password. If you create an account:
- You are responsible for keeping your password confidential and for activity that happens under your account.
- Your username is public. It appears on global leaderboards next to your scores. Choose accordingly, and do not use a username that impersonates someone else, contains slurs or sexual content, or infringes anyone else's rights.
- We may reclaim, rename or remove a username that breaks the rule above, or that is used to abuse or impersonate others.
- You can delete your account at any time from Settings, then Delete account. See section 8 of the Privacy Policy for exactly what deletion removes.
4. Acceptable Use
While using the App, please do not:
- Cheat, or use bots, scripts, emulators, memory editors, modified clients or any automation to play, to earn coins, or to post scores;
- Reverse engineer, decompile or tamper with the App, except where that right cannot lawfully be excluded;
- Interfere with the App's servers or security, attempt to access another player's account or data, or write data on behalf of another account;
- Use the App to harass, abuse or impersonate anyone;
- Attempt to interfere with the advertising that funds the App; or
- Use the App in any way that breaks the law where you live.
5. Leaderboards and Fair Play
Global leaderboards are meant to be an honest record. We may remove or reset any leaderboard entry, or any coins, streak or progress, that we reasonably believe was obtained by cheating, exploiting a bug, or otherwise breaking section 4. Where a score is clearly impossible for a given game, we may remove it without notice.
Leaderboards depend on services outside our control and may occasionally be unavailable, delayed or reset. We do not guarantee that any score, rank or streak will be preserved indefinitely.
6. Coins and Virtual Items
The App includes an in-game currency ("coins") and virtual items such as cosmetic skins, streak freezes and challenge rewards. To be clear about what these are:
- Coins are earned by playing, not bought. The App has no in-app purchases. We do not collect payment information and there is nothing to buy with real money.
- Coins and virtual items have no monetary value. They are a limited, personal, revocable licence to use a feature inside the App. They are not your property, not a balance, and not redeemable for cash or anything outside the App.
- They cannot be sold, traded, gifted or transferred between accounts, and we do not support any third-party service that claims to do so.
- We may change the cost, availability, earn rate or behaviour of any virtual item, or retire one entirely, as we balance the games.
- Unused coins and items are lost when you delete your account, and we are not required to compensate you for them.
7. Advertising
The App is free and funded by advertising served through Google AdMob. Rewarded ads, the ones that grant coins or a revive, are always optional and you can simply decline them. Your choices around personalized advertising and the advertising identifier are described in sections 2.5 and 7 of the Privacy Policy.
8. Notifications
The App can send you reminders scheduled on your device, such as a nudge to keep your daily streak alive, and occasional announcements sent from us. You can turn notifications off at any time in the App's settings or in your device's system settings. What this involves is described in the Privacy Policy.
9. Changes to the App
We add a new game most months, and we tune, update and occasionally retire existing ones. We may change, add or remove features and games at any time. We try to avoid it, but an update may reset or migrate progress in a specific game. Nothing in these Terms is a promise that a particular game, feature or release schedule will continue.
10. Intellectual Property
The App, including its games, code, artwork, sounds, names and branding, belongs to us or our licensors and is protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own private entertainment. You may not copy, distribute, publish, sell or create derivative works from it, except where the law gives you that right regardless.
Recording or streaming your own gameplay for non-commercial purposes is fine, and you are welcome to credit trendplay.games.
11. Ending Your Access
You can stop using the App at any time by deleting your account, uninstalling it, or both. We may suspend or terminate access to an account that breaks these Terms, particularly section 4. Where it is reasonable and lawful to do so, we will tell you why. Sections 6, 10, 12, 13 and 14 continue to apply after your access ends.
12. Disclaimers
The App is provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the App will be uninterrupted, error free, or that scores, progress or cloud syncing will always succeed.
Nothing in these Terms excludes or limits any right you have that cannot lawfully be excluded or limited, including mandatory consumer rights in your country.
13. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost progress, lost coins or lost leaderboard standing, arising from your use of the App. Because the App is provided free of charge, our total liability to you for any claim relating to the App is limited to the amount you have paid us for it, which is nothing, or to the minimum amount the law requires where a higher floor applies.
Again, this does not affect rights that cannot lawfully be limited, including mandatory consumer rights.
14. Governing Law
These Terms are governed by the laws of the country in which the publisher is established, without regard to its conflict of law rules. If you are a consumer resident in the European Economic Area or the United Kingdom, you keep the benefit of any mandatory protections of the law of the country you live in, and you may bring proceedings in your local courts. Nothing in this section takes those rights away.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the new version at https://trendplay.games/terms. Material changes will be communicated where required by law. Continuing to use the App after an update means you accept the revised Terms. If you do not accept them, please stop using the App and delete your account.
